Cap Refinery Emissions 5/31

KALW_RichmondRefinery_Master.jpgAfter three years of our work to stop the potential rise of greenhouse gases and toxic pollutants at the largest industrial emitters in the Bay Area, the Air District (BAAQMD) is finally holding the first hearing on Rule 12-16, which would put a cap on the emissions of each emitter. All those who can attend this hearing at the BAAQMD offices, 375 Beale Street, San Francisco on May 31 at 9:45 am, are strongly urged to do so.

The industry and BAAQMD staff have consistently opposed this Rule. The staff have prepared a deficient Draft Environmental Impact Report, which would undermine the approval and make the Rule vulnerable to industry legal challenge. Therefore, our coalition in support of capping refinery emissions will be demanding that the board direct the staff to make the following changes to the DEIR before it can be certified. This must be done before a vote on approval. 

  • Revise the DEIR to disclose the local health and climate impacts that Rule 12-16 could prevent. The EIR fails to disclose health impacts on local communities from particulate matter, the major cause of premature deaths from air pollution.
  • Revise the DEIR to disclose the problem Rule 12-16 is needed to solve. If refineries switch to dirtier crude or increase production for export local emissions will rise.
  • Adopting BOTH Rule 12-16 AND Rule 13-1 is the environmentally superior alternative. The staff have offered an “alternative” Rule 13-1, which would cap emissions-per-barrel, which they claim is the superior alternative. We agree with the CA Air Resources Board that a combination of both Rules working together are the superior alternative.
